Can I File a Concept Patent

Posted by Michael Shimokaji | Jan 13, 2015 | 0 Comments

Question: I have developed a product that is not showing in the us pto search. My question is can I do a concept patent first before a design or utility patent?

Answer: There is really no such thing as a concept patent. There are, however, broad patents that can cover broad concepts. A patent needs to provide enough information to enable another to make and use the invention. Therefore, a patent cannot simply describe a concept, but it needs to provide enough details to make the concept.
